1. Agreement

By using Budgitrack, you agree to these terms. Budgitrack is a product of Recurse Ltd. ("we", "our", "us"), a company registered in England and Wales (Companies House #17099474). These terms form a contract between you and Recurse Ltd.

2. Use of the App

Budgitrack is provided for personal budget tracking. You are responsible for the accuracy of the data you enter. You must be at least 13 years old to use Budgitrack.

3. Subscriptions

Premium subscriptions are billed through Apple. Two subscription options are available:

  • Monthly — billed every 1 month, with a 1-week introductory free trial for new subscribers.
  • Yearly — billed every 1 year.

Current pricing is shown in the App Store at the time of purchase, in your local currency.

Auto-renewal. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package.

Managing your subscription. Subscriptions may be managed by you and auto-renewal may be turned off by going to your Apple Account Settings after purchase.

Free trial forfeiture. Any unused portion of a free trial period will be forfeited when you purchase a subscription, where applicable.

4. Lifetime Purchase

The lifetime purchase grants permanent access to all Premium features for as long as Budgitrack is available, with no recurring charges. Current pricing is shown in the App Store at the time of purchase.

5. Cancellation and refunds

You may cancel a subscription at any time through your Apple Account settings. Cancellation takes effect at the end of the current billing period; we do not provide partial refunds for unused subscription time.

All refund requests for purchases made through the App Store are handled by Apple in accordance with Apple's policies. Visit reportaproblem.apple.com to request a refund.

6. Right to cancel (UK / EU consumers)

If you are a consumer based in the UK or EU, you have a statutory right to cancel a digital purchase within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 in the UK, or the Consumer Rights Directive in the EU.

By starting to use Premium features (including starting a free trial), you expressly request immediate supply of the digital content and acknowledge that you will lose your right to cancel once the supply has begun. Where the right to cancel still applies, refund requests should be directed to Apple via reportaproblem.apple.com.

7. Your data

Your budget data is stored locally on your device. We do not have access to it. We are not responsible for data loss due to device failure, lost devices, or operating-system issues. We recommend regular device backups (Apple iCloud Backup or Mac Time Machine covers most users). For details on what we do and do not collect, see our Privacy Policy.

8. Intellectual Property

Budgitrack, its name, design, trademarks, logos, and underlying software are the property of Recurse Ltd. We grant you a personal, non-exclusive, non-transferable, revocable licence to use Budgitrack for your personal, non-commercial use. You may not copy, modify, distribute, reverse-engineer, or create derivative works from Budgitrack except to the extent permitted by applicable law.

9. Limitation of Liability

Budgitrack is provided "as is" and on an "as available" basis. The information and calculations Budgitrack provides are intended as informational only and do not constitute financial advice. We are not liable for financial decisions made based on the app's calculations.

To the maximum extent permitted by law, our total liability arising from your use of Budgitrack, in aggregate, will not exceed the amount you have paid us in the 12 months preceding the event giving rise to the liability.

Nothing in these terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be limited or excluded under English law.

10. Termination

You may stop using Budgitrack at any time by deleting the app. We may suspend or terminate your access if you breach these terms, attempt to abuse the service, or use the app for unlawful purposes. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will continue to apply.

11. Changes to these terms

We may update these terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of Budgitrack after a change constitutes acceptance of the updated terms.

12. Governing law and jurisdiction

These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer based outside England and Wales, you retain the benefit of any mandatory consumer-protection laws of your country of residence.

13. Apple-specific terms

The following terms apply where you have downloaded Budgitrack from the Apple App Store. They are required by Apple in addition to the rest of these terms.

  • Acknowledgement. These terms are between you and Recurse Ltd. only, and not with Apple. Recurse Ltd., not Apple, is solely responsible for Budgitrack and its content.
  • Scope of licence. The licence granted to you for Budgitrack is limited to a non-transferable licence to use Budgitrack on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
  • Maintenance and support. Recurse Ltd. is solely responsible for providing any maintenance and support services for Budgitrack. Apple has no obligation whatsoever to provide any maintenance and support services in relation to Budgitrack.
  • Warranty. Recurse Ltd. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Budgitrack to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Budgitrack to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Budgitrack.
  • Product claims. Recurse Ltd., not Apple, is responsible for addressing any claims by you or any third party relating to Budgitrack or your possession or use of it, including: (i) product liability claims; (ii) any claim that Budgitrack fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation.
  • Intellectual-property claims. In the event of any third-party claim that Budgitrack or your possession and use of Budgitrack infringes that third party's intellectual-property rights, Recurse Ltd. (not Apple) is solely responsible for the investigation, defence, settlement, and discharge of any such claim.
  • Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country; and (ii) you are not listed on any US Government list of prohibited or restricted parties.
  • Third-party beneficiary. You and Recurse Ltd. acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these terms, and that, upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary thereof.
